1. Acceptance of Terms
By downloading, installing, or using Famzee ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and Famzee ("we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the updated Terms.
2. Description of Service
Famzee is a family memory and coordination platform that provides the following features:
- Family calendar and event coordination across households
- Shared photo galleries and memory albums for family circles
- AI-powered scrapbooks and memory highlight reels
- Co-parenting coordination tools including custody schedule tracking and handoff logs
- Voice notes and multimedia memory capture
- Location sharing within family circles (opt-in)
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice to users.
3. User Accounts
You must be at least 13 years of age to create an account and use Famzee. By creating an account, you represent and warrant that you meet this age requirement.
In compliance with the Children's Online Privacy Protection Act (COPPA), Famzee does not knowingly collect personal information from children under the age of 13. Children may appear as subjects in photos and memories shared by adult account holders, but children under 13 may not hold accounts or directly provide personal information to the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account at support@famzeeapp.com.
You agree to provide accurate, current, and complete information when creating your account and to update that information as necessary to keep it accurate.
4. User Content
Famzee allows you to upload, store, and share content including photos, videos, voice notes, text, and other materials ("User Content"). You retain full ownership of all User Content you submit to the Service.
By uploading User Content, you grant Famzee a limited, non-exclusive, royalty-free license to store, process, display, and transmit your content solely for the purpose of providing the Service to you and your designated family circle members. We do not claim ownership of your content and will not use your personal photos or memories for advertising, training AI models on identifiable individuals, or any purpose beyond operating the Service.
You represent and warrant that: (a) you own or have the necessary rights to the content you upload; (b) your content does not violate the privacy, intellectual property, or other rights of any third party; and (c) your content does not contain material that is unlawful, harmful, defamatory, or otherwise objectionable.
We reserve the right to remove User Content that violates these Terms or applicable law, with or without prior notice.
5. Subscription Terms
Famzee offers both free and premium subscription tiers. Premium features are available through a paid subscription managed via Apple's App Store and RevenueCat as our subscription infrastructure provider.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged upon confirmation of purchase and at the start of each renewal period.
You may cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. We do not offer refunds for unused portions of a subscription period, except as required by applicable law or Apple's refund policies.
We reserve the right to change subscription pricing with reasonable advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
6. Privacy
Your privacy is important to us. Our Privacy Policy, incorporated into these Terms by reference, describes how we collect, use, and share information about you when you use the Service. By using Famzee, you agree to the collection and use of your information as described in our Privacy Policy.
7. Prohibited Use
You agree not to use the Service to:
- Upload, share, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Upload content depicting child exploitation or abuse of any kind
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Violate the privacy of others, including sharing another person's location or personal information without consent
- Attempt to gain unauthorized access to any portion of the Service or its related systems
- Use automated scripts, bots, or scrapers to access or interact with the Service
- Circumvent, disable, or otherwise interfere with security-related features of the Service
- Use the Service for any commercial purpose without our prior written consent
8. Termination
You may delete your account at any time through the account settings within the App. Upon deletion, we will initiate removal of your personal data in accordance with our data retention policy described in the Privacy Policy.
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, if we determine that you have violated these Terms or if continued access poses a risk to other users or the integrity of the Service.
Upon termination, provisions of these Terms that by their nature should survive — including ownership provisions, warranty disclaimers, indemnity, and limitations of liability — shall remain in effect.
9. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law, Famzee shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
In no event shall Famzee's total liability to you for all claims exceed the amount you paid to us in the twelve months preceding the claim, or one hundred dollars ($100.00), whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
10. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you via in-app notification, push notification, or email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
We encourage you to review these Terms periodically. The "Last updated" date at the top of this page indicates when these Terms were most recently revised.
